Terms of Service for Scoopilot

By accessing or using Scoopilot (the "Service"), a platform operated by Servicd ("Company," "we," "us," or "our"), you ("Subscriber," "Pilot," or "User") agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

1. The Service

Scoopilot provides business management software, automated routing, and AI-driven voice reception services ("Voice AI"). The Service is provided on a subscription basis for business use only.

2. Subscriptions and Member Pricing

  • Plans: Subscriptions are billed monthly in advance.
  • Member Pricing: Subscribers with an active Scoopilot software plan (Solo, Walk, Run, or Grow) are eligible for discounted "Member Pricing" on Voice AI plans.
  • Cancellation: If you cancel your core Scoopilot subscription, your Voice AI plan will automatically revert to "Market Pricing" at the next billing cycle.

3. Usage-Based Billing & Overages

Certain features of the Service are subject to usage limits. By using these features, you authorize us to charge your payment method on file via Stripe for any overages incurred during the billing period.

  • Voice AI Minutes: Each plan includes a base number of minutes (60 or 200). Usage exceeding this limit is billed at $0.50 per minute. All calls are rounded up to the nearest whole minute for billing purposes.
  • SMS Messaging: Each plan includes a base number of SMS segments. Usage exceeding this limit is billed at $0.03 per SMS segment or $0.05 per MMS segment.
  • Calculations: Usage is calculated based on data provided by our telephony and AI partners (Retell/Twilio). Our internal logs are the definitive record for billing purposes.

4. AI Voice Agents and Compliance

  • Recording Disclosure: You acknowledge that Voice AI interactions are recorded. It is your sole responsibility to comply with local, state, and federal "call recording" laws. You agree to ensure your Voice AI script includes a disclosure (e.g., "This call is recorded") if required by your jurisdiction.
  • AI Limitations: While our AI is designed to qualify leads and book jobs, we do not guarantee the accuracy of every interaction. Scoopilot is not liable for missed bookings or errors made by the AI agent.

5. Fees and Payment

  • Setup Fees: A one-time setup fee ($149) may apply. This fee is non-refundable once the custom AI script configuration has begun.
  • Non-Payment: If a recurring payment fails, we reserve the right to pause your Service, including the deactivation of your AI Voice Agent, until the balance is cleared.

6. Data Ownership

  • Your Data: You retain all rights to the customer data and call transcripts generated through your account.
  • Our License: You grant us a limited license to process this data solely to provide the Service and improve our AI models (anonymized).

7. Limitation of Liability

To the maximum extent permitted by law, Servicd and Scoopilot shall not be liable for any indirect, incidental, or consequential damages (including loss of profit or revenue) arising out of the use of the AI Voice Agent or software.

8. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia. Any disputes shall be resolved in the courts of Loudoun County, Virginia.
